LocalProxies DMCA Policy

LocalProxies is a service operated by LocalProxies (“LocalProxies,” “we,” “our,” or “us”). LocalProxies is currently in formation in Delaware, United States of America. LocalProxies respects the intellectual property rights of others and complies with the requirements of the Digital Millennium Copyright Act (DMCA). This Policy outlines the procedure for submitting copyright infringement claims and counter-notices.

1. DMCA Agent Contact

If you believe your copyrighted work has been copied, transmitted, or made available through LocalProxies in a way that constitutes copyright infringement, please contact our designated DMCA Agent:

2. Takedown Request Procedure

To file a valid DMCA takedown notice, your written request must include:

  1. A physical or electronic signature of the copyright owner or person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material;
  4. Contact information for the complaining party (name, address, telephone number, email);
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Failure to comply with all of the above requirements may result in an invalid takedown notice.

Upon receipt of a valid DMCA notice, LocalProxies will:

  • Remove or disable access to the allegedly infringing material;
  • Notify the user who posted or used the material;
  • Take appropriate repeat infringer policy actions if applicable.

3. Counter-Notice Procedure

If you believe that your material was removed or disabled in error, you may submit a counter-notice to our DMCA Agent. Your written counter-notice must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which it appeared before removal;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address;
  5. A statement that you consent to the jurisdiction of the federal court in your district (or the courts of [insert jurisdiction, e.g., Delaware] if outside the U.S.), and that you will accept service of process from the person who provided the original DMCA notice.

If we receive a valid counter-notice, we will:

  • Forward it to the original complainant;
  • Inform them that we may restore the material within 10–14 business days unless they file legal action;
  • Restore the material if no legal action is initiated within that period.

4. Repeat Infringer Policy

LocalProxies may terminate, in appropriate circumstances, users or account holders who are repeat infringers of intellectual property rights.

5. Misuse of DMCA

Submitting false claims or misrepresenting facts in a DMCA takedown or counter-notice is a violation of U.S. law and may result in liability for damages, court costs, and attorneys’ fees. We reserve the right to pursue such remedies if we believe a DMCA request was filed in bad faith.

Use of the LocalProxies Services constitutes acceptance of this DMCA Policy.
